Terms & Conditions
Welcome to Clear Kove. These Terms and Conditions govern the web development, design, and digital services we provide. By commissioning our services or using our website, you agree to be bound by these terms under South African law.
Proposals, Scopes, and Estimates
All project quotes, estimates, and proposals provided by Clear Kove are valid for 30 days from the date of issue. Any changes, additional features, or scope modifications requested outside of the finalized project agreement will be subject to supplementary billing at our standard current hourly rate.
Client Responsibilities & Delays
Timely delivery relies on collaboration. Clear Kove requires prompt feedback, content, copy, assets, and approvals from the client to meet projected deadlines. If a project stalls for more than 30 consecutive days due to missing client input or dependency delays, we reserve the right to pause the project, invoice for work completed to date, and apply a reactivation fee to resume development.
Intellectual Property & Copyright
Any pre-existing code, framework layouts, proprietary tools, or open-source infrastructure utilized during development remain the underlying property of Clear Kove or their respective creators. Ownership, copyright, and distribution rights of the specific custom layout and frontend codebase will transfer entirely to the client only once the final invoice balance has been settled and cleared in full. We reserve the right to restrict access to or suspend deployed assets if payment defaults occur.
Third-Party Services & Hosting
Clear Kove frequently integrates third-party utilities, including web hosting, payment processing systems, API providers, and premium system extensions. Clear Kove holds no liability or responsibility for platform outages, structural performance issues, security breaches, or direct losses originating from these independent third-party platforms.
Limitation of Liability
To the maximum extent permitted under the laws of the Republic of South Africa, Clear Kove, its developers, and partners shall not be held liable for any direct, indirect, operational, or consequential damages—including data breaches, system downtime, revenue loss, or security compromises—resulting from the implementation or long-term runtime of our digital products.
Governing Law
These terms are established, interpreted, and enforced strictly in accordance with the legal system of South Africa. Any unresolved disputes or formal disagreements arising directly from our commercial engagements shall remain subject to the exclusive jurisdiction of the South African courts.
